Terms of Service
These terms are a binding agreement between you and BLOOM PROCESSING LLC. Please read them carefully. By using our Services, you agree to them.
1. Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the websites, apps, and services (the “Services”) offered by BLOOM PROCESSING LLC, doing business as RxHero (“RxHero,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Who we are — and are not
RxHero is a technology platform that helps connect you with independent, licensed clinicians and pharmacies. We are not a pharmacy, a medical practice, or a provider of medical care, and we do not practice medicine or dispense medications. Medical services are provided by independent clinicians made available through our provider network, LocumTele. Medications, if prescribed, are dispensed by licensed pharmacies, including Rush Pharmacy. Clinical decisions are made solely by the treating clinician in the exercise of their independent professional judgment.
3. Eligibility
To use the Services, you must be at least 18 years old, be a resident of and physically located in a state we serve (47 states — all except California, South Carolina, and New Jersey), and be able to form a binding contract. You agree to provide accurate, current, and complete information. Providing false information — including about your identity, age, location, or medical history — can be dangerous and may result in refusal or termination of service.
4. No guarantee of treatment
Submitting a request or completing a quiz does not guarantee that you will be prescribed any medication or receive any particular treatment. A clinician licensed in your state reviews each request and may decline to prescribe if treatment is not clinically appropriate. Treatment depends on clinical eligibility and the clinician’s judgment.
5. Not for emergencies
The Services are not for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room. Do not use the Services for urgent or life-threatening conditions. See our Telehealth Consent.
6. The clinician and pharmacy relationship
When you proceed to care, you enter into a relationship directly with an independent clinician, and, if a prescription is issued, with a dispensing pharmacy. RxHero does not control and is not responsible for the independent medical judgment of clinicians or the professional services of pharmacies. Your use of those services is also subject to their terms and, where applicable, the terms of our clinical partner.
7. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or applicable law.
8. Pricing, billing, and cancellation
- All-in pricing. Prices are shown before you confirm. Any cost not included is named. We do not add hidden fees.
- Authorization. You authorize us and our pharmacy partner to charge your selected payment method for the amounts you approve, including recurring charges for any subscription you elect.
- Subscriptions. If you enroll in a recurring plan, it renews at the interval and price disclosed at enrollment until you cancel. You may cancel at any time as described in your account or by contacting support; cancellation stops future charges.
- Refunds. You are charged for medication only if it is prescribed. Refund eligibility is described at checkout and in our support policies. For safety and legal reasons, dispensed prescription medications generally cannot be returned or refunded once shipped.
- Insurance. We do not bill insurance. Payment is made directly to us or our pharmacy partner.
9. Prescriptions and fulfillment
If a clinician issues a prescription, it is filled by a licensed pharmacy and shipped to you in discreet packaging. Medications are dispensed subject to the pharmacy’s and clinician’s professional judgment and applicable law. Use medications only as directed, do not share them, and dispose of unused medication safely.
10. Your responsibilities and acceptable use
- Provide accurate, complete, and current information.
- Tell your clinician about all medications, allergies, and conditions, and report side effects promptly.
- Do not resell, share, or misuse prescription medication.
- Do not misuse the Services, interfere with their operation, attempt unauthorized access, or use them for unlawful purposes.
- Do not scrape, copy, or reverse-engineer the Services except as permitted by law.
11. Intellectual property
The RxHero name, logo, and the content and software that make up the Services are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not use our marks or content without our prior written permission.
12. Disclaimers
The Services are provided “as is” and “as available.” Content on our marketing site is general information and is not medical advice; medical advice comes only from your treating clinician. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law, BLOOM PROCESSING LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, and these limitations do not apply to the independent medical judgment of treating clinicians.
14. Indemnification
You agree to indemnify and hold harmless BLOOM PROCESSING LLC and its affiliates from claims and expenses arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Dispute resolution; arbitration; governing law
These Terms are governed by the laws of the state in which BLOOM PROCESSING LLC is organized, without regard to conflict-of-law rules. Except where prohibited by law, you and we agree to resolve disputes through binding individual arbitration rather than in court, and you and we waive the right to a jury trial and to participate in a class action. You may opt out of arbitration by notifying us in writing within 30 days of first accepting these Terms. This section does not prevent either party from seeking relief in small-claims court or injunctive relief for intellectual-property misuse.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new effective date and provide additional notice where required. Your continued use after an update means you accept the revised Terms.
17. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or applicable law, or to protect the Services or others. Provisions that by their nature should survive termination will survive.
18. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and Telehealth Consent, are the entire agreement between you and us regarding the Services.
